Fidelity Digital Asset Services has agreed to a $500,000 settlement with California’s attorney general that would require it to notify California customers if it ever ends the ability to transfer crypto to external wallets. The settlement, signed on October 14, 2026, puts a formal consumer-protection condition on a feature that many crypto holders rely on to move their assets off the platform.
The agreement was fully executed by California’s Office of the Attorney General and centers on one specific obligation: if Fidelity stops letting customers send crypto to wallets outside the Fidelity platform, it must first notify those California customers. The settlement does not require Fidelity to keep the feature running indefinitely. For related coverage, see Australia Proposes Crypto Tax Reporting Rules for 2028.
What the Settlement’s Notice Requirement Actually Means
The core condition is a notice trigger, not a ban on ending the service. Under the terms, Fidelity would only be required to inform California customers before discontinuing external-wallet crypto transfers. The company retains the right to end that feature if it chooses to do so.
This distinction matters for anyone who holds crypto through Fidelity. The settlement gives customers advance warning if that option goes away, but it does not guarantee the option stays available. Think of it as a required heads-up, not a permanent protection.
The $500,000 figure represents the settlement amount agreed to in the case. No further financial penalties are described in the headline or document title beyond that sum.
Why External Wallet Transfers Matter to Crypto Holders
An external-wallet transfer lets a customer move crypto out of their Fidelity account and into a separate wallet they control directly, whether that is a hardware device or a software wallet on their phone. It is the difference between holding crypto on a platform versus holding it yourself.
Losing the ability to transfer out would mean customers could only buy, sell, or hold crypto within Fidelity’s system. They could not move their holdings to another exchange or into personal storage. For customers who want direct control over their assets, that is a significant restriction.
Regulatory scrutiny of crypto custody and wallet access has been growing across the country. The SEC has proposed separate crypto custody rules for investment advisers and funds, which could further shape how platforms like Fidelity handle customer assets going forward. Separately, FinCEN withdrew its proposed rules targeting external wallet transfers and crypto mixing, leaving that regulatory space still in flux.
Fidelity has been expanding its crypto offerings for retail customers. Fidelity’s spot Bitcoin ETF has drawn significant investor inflows, showing strong customer demand for its crypto products. The settlement suggests state regulators want baseline consumer protections in place as that footprint grows.
What California Customers Should Watch For
If Fidelity decides to end external-wallet transfers, California customers should receive official notice before any change takes effect. That notification is the key protection this settlement creates. Customers in other states are not covered by this agreement’s notice requirement.
Any actual service change would come through official Fidelity communications, such as account emails or in-app notices. Customers who regularly use external transfers to move crypto to personal wallets should watch those channels closely.
The settlement was executed in mid-October 2026. Customers who want to review the full terms can access the signed agreement through California’s attorney general office. No service change has been announced by Fidelity as of the settlement date.
If you use a platform for crypto storage and that platform changes its transfer policies, the window to act is between receiving notice and the change going live. Knowing how to move assets to a personal wallet before any deadline is practical preparation, not speculation. For a real-world example of how quickly access windows can close, Cobo Wallet’s December shutdown shows what it looks like when customers face a hard deadline to withdraw their funds.
